The National Supermarket Association and two members, City Fresh Market and C-Town Supermarket, filed a lawsuit against New York City's city-owned grocery store plan in the Southern District of New York. The plaintiffs claim that the millions of dollars funding the plan would create an unfair advantage and violate antitrust laws. Mayor Zohran Mamdani said he wants to spend in upwards of $70 million on the plan. The city has chosen sites for two of the five locations and announced that selected items, including produce, meat, bread and milk, will be priced 30% below average market prices.
Why this matters: Independent stores near the planned locations could face competition from a publicly funded program offering lower prices. The lawsuit shows that store operators and their associations are challenging the plan's competitive effects and legal basis.
