FMI and the NGA urged the FTC to distinguish personalized promotions, such as loyalty coupons, from personalized pricing based on personal data. The FTC says undisclosed collection or use of personal data for personalized pricing could violate the FTC Act. Both groups defended electronic shelf labels, saying grocers use them to maintain pricing accuracy and reduce the labor of changing manual price tags. They asked the FTC for clearer compliance standards and a lower enforcement burden if it issues a final enforcement statement.

Why this matters: Independent grocers that use loyalty programs or electronic shelf labels could be affected by how the FTC defines and enforces personalized pricing. Clearer standards could help stores separate ordinary promotions and price displays from practices that use personal data to set prices.
